Title: Power of Reserve Bank to Give Directions

In the discharge of its functions under this Act, the Trust shall be guided by such directions in matters of policy involving public interest as the1[Development Bank] may give to it in writing, and if any question arises whether the direction relates to a matter of policy involving public interest, the decision of Reserve Bank thereon shall be final. ______________________ 1. Title: Power of Central Government to Issue Directions to Board

1["(1) Without prejudice to the foregoing provisions of this Chapter, the Authority and every Board shall, in the discharge of its functions under this Act be bound by such directions on questions of policy as the Central Government may give in writing from time to time; Provided that the Authority or the Board, as the case may be, shall be given Opportunity to express its views before any direction is given under this sub-section.".] (2) The decision of the Central Government whether a question is one of policy or not shall be final. ________________________ 1. Title: Power of Central Government to Direct Regulations to Be Made or to Make Regulations

.....order in writing together with a statement of reasons therefor, direct any Board to make any regulations for all or any of the matters specified in section 28 or section 76 or section 123 or to amend any regulations, within such period as the Central Government may specify in this behalf : Provided that the Central Government may extend the period specified by it by such period or periods as it may consider necessary. (2) If any Board, against whom a direction is issued by the Central Government under sub-section (1), fails or neglects to comply with such direction within the period allowed under sub-section (1), that Government may make the regulations or amend the regulations, as the case may be, either in the form specified in the direction or with such modifications thereof as the Central Government may think fit : Provided that, before so making or amending the regulations, the Central Government shall consider any objection or suggestion made by the Board within the said period. (3) Where, in pursuance of sub-section (2), any regulations have been made or amended, the regulations so made or amended shall be published by the Central Government in the Official.....

Central Boards of Revenue Act 1963 Section 3

Title: Constitution of Separate Central Boards for Direct Taxes and for Excise and Customs

(1) The Central Government shall, in place of the Central Board of Revenue, constitute two separate Boards of Revenue to be called the Central Board of Direct Taxes and the Central Board of Excise and Customs, and each such Board shall, subject to the control of the Central Government, exercise such powers and perform such duties, as may be entrusted to that Board by the Central Government or by or under any law. (2) Each Board shall consist of such number of persons1[not exceeding seven] as the Central Government may think fit to appoint. ___________________________ 1. Specific Relief Act 1963 Part II

Title: Specific Relief

.....the performance of which involves the performance of a continuous duty which the court cannot supervise. (2) Save as provided by the Arbitration Act, 1940, no contract to refer present of future differences to arbitration shall be specifically enforced; but if any person who has made such a contract (other than arbitration agreement to which the provisions of the said Act apply) and has refused to perform it, sues in respect of any subject which he has contracted to refer, the existence of such contract shall bar the suit. (3) Notwithstanding anything contained in clause (a) or clause (c) or clause (d) of sub-section (1), the court may enforce specific performance in the following cases:-- (a) where the suit is for the enforcement of a contract,-- (i) to execute a mortgage or furnish any other security for securing the repayment of any loan which the borrower is not willing to repay at once: Provided that where only a part of the loan has been advanced the vender is willing to advance the remaining part of the loan in terms of the contract; or (ii) to take up and pay for any debentures of a company; (b) where the suit is for,-- (i) the execution of a formal deed.....

Title: Special Provision for Enforcement of Claim by the Trust

.....specified in the notice why the management of the company or other body corporate should not be transferred to the Trust. (5) Before passing any order under sub-section (3) or sub-section (4), the Court may, if it thinks fit, examine the officer making the application. (6) At the same time as it passes an order under sub-section (3), the Court shall issue to the company or other body corporate a notice accompanied by copies of the order, the application and the evidence, if any, recorded by it calling upon the company or other body corporate to show cause on a date to be specified in the notice why the ad interim order of attachment should not be made absolute or the injunction confirmed.
