(2) Where the licence is transferred and the proceeds of the transfer (so far as they consist of capital sums) are less than the expenditure incurred remaining unallowed, a deduction equal to such expenditure remaining unallowed, as reduced by the proceeds of the transfer, shall be allowed in respect of the previous year in which the licence is transferred. ..... 16. Penalties. (1) If any person contravenes, or attempts to contravene, or abets the contraventions of, any of the provisions of this Act or rules he shall, on conviction, be punishable with imprisonment for a term which may extend to one month or with fine which may extend to two hundred rupees, or with fine. (2) Whoever, after conviction under sub-section (1), continues the contravention, he shall, on conviction, be punishable with fine which may extend to one hundred rupees for everyday, after the first day, during which such contravention continued. 17. Offence by companies. (1) Where an offence under this Act has been committed by a company, every person who, at the time the offence was committed, was in charge of and was responsible to, the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly:- Provided that nothing contained in this section shall tender any such person liable to any punishment provided in this Act if he proves that the offence was committed without his knowledge or that he had exercised all cue.....
