.....or is proved to have been, in possession of any gift goods reasonably suspected of being stolen or unlawfully obtained and cannot account satisfactorily how he came by the same, he shall be punished with imprisonment for a term which may extend to two years or with fine, or with both. Section 4 - Offences under the Act to be cognizable (1) Notwithstanding anything contained in the Code of Criminal Procedure, 1898 (Central Act 5 of 1898) any offence under this Act shall be deemed to be a cognizable offence within the meaning of that Code. (2) No court below that of a Magistrate of the First Class shall try any offence under this Act. Section 5 - Power to amend Schedules [Pub. in K.G. Ex. No. 11 dated 11-1-1963)] [(1) The Government may, by notification in the Gazette, amend Schedule I by adding the name of any goods in, or omitting the name of any goods from, the said Schedule and thereupon that Schedule shall be deemed to be amended accordingly. (2) The Government by notification in the Gazette, amend Schedule II by adding the name of any organization in, or omitting the name of any organization from, the said Schedule and thereupon that Schedule shall be deemed.....
