THE BURN COMPANY AND INDIAN STANDARD WAGON COMPANY (NATIONALISATION) ACT, 1976 [Act, No. 97 of 1976] [5th September, 1976.] PREAMBLE An Act to provide for the acquisition of the undertakings of the Burn and Company Limited and the Indian Standard Wagon Company Limited with a view to ensuring the continuity of the production of goods which are vital to the needs of the economy of the country and for the fulfilment of the contracts for the supply of railways wagons abroad and for matters connected therewith or incidental thereto. BE it enacted by Parliament in the Twenty-seventh Year of the Republic of India as follows:-

.....overnment took a number of steps lo improve the operation of such undertakings, and, as a result of such steps, both the Companies have shown satisfactory upward trends in production. However, the liabilities of both the Companies with regard to the payment of interests on loans advanced by banks, particularly in relation to the credit facilities made available to them by the banks, came up to as high as Rs. 1.5 lakhs per day. The liquidity position of the Companies was, consequently, going down steeply. In the circumstances, the Burn Company and Indian Standard Wagon Company (Nationalisation) Ordinance; 1976 (8 of 1976) was promulgated by the President to provide for the acquisition of the undertakings of the two Companies. 4. The Bill seeks to replace the said Ordinance and also to repeat the Parliamentary legislation by which the management of the undertakings of the two Companies was taken over by the Central Government.- Gaz. of Ind., 20-8-1976, Pt. Title: Powers in Respect of Burial and Burning Places

.....no suitable place for burial or burning exists within a reasonable distance, provide a filling place for the purpose. (3) If any person, without the permission of the municipality bury or burn any corpse, or permit, to be buried or burnt, any corpse at any place which is not any burial or burning ground made or formed according to the provisions of this section, or after the date fixed thereunder for closing the same, he shall be punishable with fine which may extend to five hundred rupees. (4) Private burial places may be exempted from the order subject to such conditions as the municipality may impose in this behalf: Provided that the limits of such burial places are sufficiently defined and that they shall only be used for the burial of members of the family of the owners thereof. (5) No private burial or burning ground shall be made or formed within the municipality after the commencement of this Act, without the permission in writing of the municipality.

Section 3 Taking over of management of the undertaking of the company (1) The State Government may, by an order published in the Official Gazette, take over the management of the undertaking of the company and appoint a person or body of persons for managing the undertaking of the company in accordance with the provisions of this Act and the rules made thereunder. Title: Power to Require Closing of Burial or Burning Ground

.....of, persons living in the neighbourhood, it may with the previous sanction of the Central Government by notice in writing, require the owner or person in charge of such ground to close the same from such date as may be specified in the notice. (2) Where the Central Government sanctions the issue of any notice under subsection (1) it shall declare the conditions on which the burial or burning ground may be reopened, and a copy of such declaration shall be annexed to the notice. (3) Where the Central Government sanctions the issues of any such notice, it shall require a new burial or burning ground to be provided at the expense of the cantonment fund, or, if the community concerned is willing to provide a new burial or burning ground, the Central Government shall require a grant to be made from the cantonment fund towards the cost of the same. (4) No corpse shall be buried or burnt in any burial or burning ground in respect of which a notice issued under this section is for the time being in force.

Title: Commissioner of Payments

(1) The Central Government shall, for the purpose of disbursing the amounts payable under section 7, section 8, and sub-section (2) of section 15, to each of the two companies, by notification, appoint a Commissioner of Payments. (2) The Central Government may appoint such other persons as it may think fit to assist the Commissioner and thereupon the Commissioner may authorise one or more of such persons also to exercise all or any of the powers exercisable by him under this Act and different persons may be authorised to exercise different powers. (3) Any person authorised by the Commissioner to exercise any of the powers exercisable by the Commissioner may exercise those powers in the same manner and with the same effect as if they have been conferred on that person directly by this Act and not by way of authorisation. (4) The salaries and allowances of the Commissioner and other persons appointed under this section shall be defrayed out of the Consolidated Fund of India. Section 15 - Payment by the Central Government to the Commissioner (1) The Central Government shall, within thirty days from the specified date, pay in cash to the Commissioner, for payment to each.....
