Bengal Births and Deaths Registration Act, 1873 Complete Act

.....ACT, 1873 4 of 1873 Preamble.functions.Whereas it is expedient to provide the means for a complete register of births and deaths It is hereby enacted as follows; Section 1 Power to direct registration of births and deaths and define area The 11. Words subs, by the Government India (Adaptation of Indian Laws) Order, 1937 and the Adaptation of Laws Order, 1950. [State Government] may at any time, by a notification published in the 22. Words subs, by the Government of India (Adaptation of Indian Laws) Order. 1937. [Official Gazette], direct that all births and deaths, or all births, or all deaths, occuring within the limits o any area after a certain date to be named in such notification shall be registered, and for that purpose may define the limits of such area. From and after such date this Act shall apply to the whole of the area so defined. Section 2 Magistrate may divide area into districts and may appoint registrars The Magistrate of the District may, for the purpose of such registration, divide any such area into such and so many districts as he may think fit, and may appoint one or more persons to be registrars of births or of deaths, or of births and deaths,.....

.....of the State of Bihar. The Act was extended to the Union territory of Himachal Pradesh by H.P. A.L.O., 1948. H.P. is a 'State' from 25-1-1971-See Act 53 of 1970. The Act has now been extended to the Union territories of- (1) Dadra and Nagar Haveli by Regn. 6 of 1963 (1-7-1965); (2) Pondicherry by Regn. 7 of 1963 (1-10-1963); (3) Laccadive, Minicoy and Amindivi Islands (Now called Lakshdweep) by Regn. 8 of 1965 (1-10-1967). The Act has been extended to the Union territory of Goa, Daman and Diu and enforced therein on and from 1-9-1962-See S.O. 2734 published in Gaz. of Ind., 1-9-1962, Pt. II, S. 3(ii). Extra., p. 1991. The Act has been brought into force from 11-3-1992 in the State of Sikkim-See Gaz. of Ind., 11-3-92, Pt. II, S. 3(ii), Ext., p. 2 (No. 184). PRELIMINARY SECTION 01: SHORT TITLE This Act may be called the Government Savings Banks Act, 1873. Local extent. It extends 1 to 2 [the whole of India 3 [* * *].] SECTION 02: ACT NOT TO APPLY TO DEPOSITS IN ANCHAL SAVINGS BANK This Act shall not apply to any deposits made in the Anchal Savings Bank of the State of Travancore-Cochin, and, notwithstanding anything contained in this Act, any law in force in the said State.....

Title: Of the Construction and Maintenance of Works

.....if, after the receipt of such order, the persons to whom it is addressed do not, within the said period, construct or repair such works to the satisfaction of the said Canal-officer, he may, with the previous approval of the Superintending Canal-officer, himself construct or repair the same;(If they fail canal officer may construct.) and if the said persons do not, when so required, pay the cost of such construction or repairs as declared by the Divisional Canal officer, the amount shall, on the demand of the Divisional Canal Officer, be recoverable from them by the Collector as if it were a arrear of land-revenue.(and recover cost.) Title: Adjustment of Claims Between Persons Jointly Using Water Course

If any person, jointly responsible with others for the construction or maintenance of a water-course, or jointly making use of a water-course with others, neglects or refuses to pay his share of the cost of such construction or maintenance, or to execute his share of any work necessary for such construction or maintenance, the Divisional or Sub-divisional Canal-officer, on receiving an application in writing from any person injured by such neglect or refusal, shall serve notice on all the parties concerned that, on the expiration of a fortnight from the service, he will investigate the case; and shall, on the expiration of that period, investigate the case accordingly, and make such order thereon as to him seems fit. Such order shall be appealable to the Commissioner, whose order thereon shall be final. Any sum directed by such order to be paid within a specified period may, if not paid within such period, and if the order remains in force be recovered by the Collector, from the person directed to pay the same, as if it were an arrear of land-revenue.(Recovery of amount found due)

.....cultivating tenant of water supplied by the owner of a water-course for the irrigation of the land held by such tenant; transfer, with land, of contracts for water: But all contracts made between the19 [State Government] and the owner or occupier of any immovable property, as to the supply of canal water to such property, shall be transferable therewith, and shall be presumed to have been so transferred whenever a transfer of such property takes place; no right acquired by user : (f) No right to the use of the water of a canal shall be, or be deemed to have been acquired under the Indian Limitation Act, 1877, Part IV, nor shall the19 [State Government] be bound to supply any person with water except in accordance with the terms of a contract in writing. SECTION 33: LIABILITY WHEN PERSON USING UNAUTHORISEDLY CANNOT BE IDENTIFIED If water supplied through a water-course be used in an unauthorised manner, and if the person by whose act or neglect such use has occurred cannot be identified, the person on whose land such water has flowed if such land has derived benefit therefrom, or if such person cannot be identified or if such land has not derived benefit therefrom, all the persons.....
