.....of the Governor on the 7th November, 1993 and is hereby published for general information:- Tripura Act No. 7 of 1993 THE TRIPURA PANCHAYATS ACT, 1993 An Act to recognise Panchayats in rural areas of Tripura and to provide for matters connected therewith or incidental thereto. Whereas it is expedient and necessary to replace the present statute relating to Panchayats to bring it in conformity with the purpose, substance and direction of the Constitution (Seventy third) Amendment Act, 1992 which came into force on 24th April, 1993, in general, and, in particular, to endow the Panchayats with functions and powers so as to enable them to function as vibrant institutions of local self-government with greater peoples' participation in managing their own affairs besides imparting certainty, continuity and democratic content and dignity aiming, among other things, at the realisation of economic and social justice. Be it enacted by the Tripura Legislative Assembly in the Forty fourth Year of the Republic of India, as follows :------ PART I Preliminary CHAPTER I Short Title, extent and commencement. 1. SECTION 10: ACT TO HAVE OVERRIDING EFFECT, BUT SHALL BE IN ADDITION TO EXISTING LOCAL AUTHORITY LAWS (1)The provisions of this act and the rules shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force. (2)Subject to the provisions of sub-section(1) the provisions of this Act shall be in addition to and shall not, as expressly provided hereinbefore, be in derogation of the provisions of any law relating to Municipal Corporation, Municipal Council or other local authority concerned. .....of split.-- Where a member of a House makes a claim that he and any other members of his legislature party constitute the group representing a faction which has arisen as a result of a split in his original political party and such group consists of not less than one third of the members of such legislature party,-- (a) he shall not be disqualified under sub-paragraph (1) of paragraph 2 on the ground-- (i) that he has voluntarily given up his membership of his original political party; or (ii) that he has voted or abstained from voting in such House contrary to any direction issued by such party or by any person or authority authorised by it in that behalf without obtaining the prior permission of such party, person or authority and such voting or abstention has not been condoned by such party, person or authority within fifteen days from the date of such voting or abstention; and (b) from the time of such split, such faction shall be deemed to be the political party to which he belongs for the purposes of sub-paragraph (1) of paragraph 2 and to be his original political party for the purposes of this paragraph. 5.
