(1) Notwithstanding that the person for the adjustment of whose debts an application has been made under section 4 or any of his creditors does not appear on the date fixed for the hearing of the application or on any date to which it may be adjourned, the Court shall proceed ex parte to hear the application, decide the preliminary issues and, if necessary, make the award, on the evidence available. (2) When an application made under section 4 is heard and disposed of ex parte under sub-section (1), the decision on the preliminary issues or the award shall not, except for sufficient reasons, be re-opened merely on the ground that any of the parties thereto did not appear at the hearing.

Title: Performance of Duties of Absent Judge

(1) During any absence of the Chief Judge or any Judge of the said Court, or during the period for which any Judge is acting as Chief Judge, the State Government may appoint any person, having {Subs.by the A.O.1937 for "the qualifications required by s.7".As to requisite qualifications of Chief Judge, see Constitution of India, Art.233; of other Judges see rules under Art.234, ibid.}[the requisite qualifications], to act as Chief Judge or Judge of the said Court, as the case may be. (2) Every person so appointed shall be authorized to perform the duties of the Chief Judge or a Judge of the said Court until the return of the absent Chief Judge or Judge, or of the Judge acting as Chief Judge, or until the State Government sees cause to cancel the appointment of such acting Chief Judge or Judge, as the case may be.

(1) In any proceeding before him under this Act, the Magistrate may pass such interim order as he deems just and proper.
