.....AND ALLOWANCES) ACT, 1977 SIKKIM MINISTERS, SPEAKER, AND DEPUTY SPEAKER AND MEMBERS OF THE LEGISLATIVE ASSEMBLY (SALARIES AND ALLOWANCES) ACT, 1977 ACT NO.4 of 1977 AN ACT To provide for the salaries and allowances of the Ministers, the Speaker, the Deputy Speaker and Members of the Legislative Assembly of the State of Sikkim. [28th March, 1977] Be it enacted by the Legislature of Sikkim in the Twenty-eighth Year of the Republic of India as follows: Short title and Commencement. 1. (I) This Act may be called the (Subs. by see 2 (a) of the S. S. & A. (Amd.) Act, No.6 of 1980 (w.e.f.25.l0.1979) [Sikkim Ministers, Speaker, Deputy Speaker and Members of the Legislative Assembly (Salaries and Allowances) Act,] 1977. (2) The provisions of this Act shall come into force at once except the provisions of section 3 which shall come and shall always be deemed to have come into force with effect from the Ist day of April, 1976. Definitions. 2. In this Act, unless there, is anything repugnant in the subject or context, (a) 'Assembly' means the Legislative Assembly of the State of Sikkim. (b) 'Chief Minister', 'Minister', 'Minister of State' and 'Deputy.....

.....{For notification declaring the Kirk Sessions at Calcutta Madras, Bombay and Allahabad to be duly constituted, see Gazette of Indian 1900 , Pt.I, p.706 respect of the Kirk Session Simla and the Kirk Session at Simla and the Kirk Session at Poona, see ibid 1905, Pt, I p, 706 respectively.} in pursuance of an Act of the General Assembly of the Church of Scotland, is hereby declared to be and the same shall be a body corporate having perpetual succession and a common seal. (2) A notification by the Central Government in the Official Gazette that a Kirk Session has been duly constituted {For notification declaring the Kirk Sessions at Calcutta Madras, Bombay and Allahabad to be duly constituted, see Gazette of Indian 1900 , Pt.I, p.706 respect of the Kirk Session Simla and the Kirk Session at Simla and the Kirk Session at Poona, see ibid 1905, Pt, I p, 706 respectively.} In pursuance of an Act of the General Assembly of the Church of Scotland shall be conclusive proof that it has been so constituted.

WHEREAS there are in{ Subs. by the A, O, 1950 for "the Provinces".} [India] Kirk Sessions of the Church of Scotland which have been duly constituted to be Church Courts for ecclesiastical purposes in pursuance of Acts of the General Assembly of the Church of Scotland; And whereas it is expedient that such Kirk Sessions and any others which may hereafter be so constituted, should be incorporated with the powers hereinafter provided; It is hereby enacted as follows:--

Section 3 Establishment of City Sessions Court (1) The State Government may, by notification in the Official Gazette, establish for the Presidency-town of Calcutta a Court of Session to be called the City Sessions Court. (2) The City Sessions Court shall be deemed to be a Court subordinate to and subject to the superintendence of the High Court within the meaning of the Letters Patent for the High Court and of the Code. Section 4 Appointment of Judges (1) There shall be appointed, a Chief Judge of the City Sessions Court and as many other Judges of that Court as the State Government thinks fit. (2) The Chief Judge of the City Civil Court and the other Judges of that Court may be appointed in addition to their duties in that Court as the Chief Judge and the other Judges of the City Sessions Court. Title: Power to Hold and Dispose of Property

(1) Every Kirk Session constituted as aforesaid shall, as body corporate, have power to acquire and hold any property which has been, or may hereafter be, vested in it for the purposes of the Congregation for which it has been, or may hereafter be, constituted or of any trust which may have been, or may hereafter be, accept by it' to transfer the same, to contract and to do all other thing necessary for, or incidental to, the purposes of its constitution or o any such trust as aforesaid. (2) The signature of the Moderator and Treasurer or Session-clerk for the time being of a Kirk Session constituted as aforesaid shall if affixed on behalf and by order of the Kirk Session, be sufficient for all purposes for which the signature of the Kirk Session is required

The Central Government may set apart any buildings or vessels or any parts thereof as naval prisons or naval detention quarters and any buildings, vessels or parts of buildings or vessels so set apart as naval prisons or naval detention quarters, as the case may be, shall be deemed to be naval prisons or naval detention quarters respectively, within the meaning of this Act.
