THE BOMBAY CORNEAL GRAFTING ACT, 1957 [ Act No. 33 of 1957]1 [4th September, 1957] PREAMBLE An Act to make provision with respect to the use of eyes of deceased persons for therapeutic purposes. WHEREAS it is expedient to make provision with respect to the use of eyes of deceased persons for therapeutic purposes; It is hereby enacted in the Eighth Year of the Republic of India as follows :- NOTES No provision is made in the Bombay Anatomy Act, 1949, to make available material for corneal grafting surgery. Nor did any provision is made to bequeath the donors eyes to the patient for grafting purposes. The Act has made provision for voluntary use of eyes indicated by a person's willingness for the bequest of his eyes for therapeutic purpose after his death. Then the person lawfully in possession of the body of the aforesaid person after his death, may authorise the removal of the eyes from the body. IV-B. p. 127) In exercise of the powers conferred under sub-section (3) of section 1 of the Bombay Corneal Grafting Act, 1957 (Bom. XXXIII of 1957), the Government of Maharashtra specifies the 10th of August, 1960, to be the date on which the said Act shall come into force in all the areas of the State of Maharashtra. G. N., U. D., P. H. & H. D., No. DSP. 3768/6535-H, dated 13th October, 1969 (M. G., Pt. IV-B. p. 1522) In exercise of the powers conferred by clause (a) of section 2 of the Bombay Corneal Grafting Act, 1957 (Bom. XXXIII of 1957), the Government of Maharashtra hereby approves the following hospitals for the purposes of the said Act, namely :- (1) K.E.M. Hospital, Bombay. (2) Haji Bachooali Hospital, Bombay. THE KERALA CORNEAL GRAFTING (AMENDMENT) ACT, 1988 [1] THE KERALA CORNEAL GRAFTING (AMENDMENT) ACT, 1988 [1] (ACT 21 OF 1988) An Act to amend the Kerala Corneal Grafting Act, 1963 Preamble. " whereas it is expedient to amend the Kerala Corneal Grafting Act, 1963, for the purpose hereinafter appearing; be it enacted in the Thirty-ninth Year of the Republic of India as follows: " 1. Short title and commencement." (1) This Act may be called the Kerala Corneal Grafting (Amendment) Act, 1988. (2) It shall come into force at once. 2. Amendment of section 3. "In the Kerala Corneal Grafting Act, 1963 (17 of 1963), in section 3, after sub-section (6), the following sub-section shall be inserted, namely: " "(6A) Where the body of a person has been sent for post-mortem examination" (a ) for medico-legal purposes by reason of the death of such person having been caused by accident or any other unnatural cause; or (b ) for pathological purposes, the person competent under this Act to give authority for the removal of the eyes from such dead body may, if he has reason to believe that the eyes will not be required for the purpose for which such body has been sent for post-mortem.....

.....provisions of this Act shall be construed as rendering unlawful any dealing with the body or any part thereof, of a deceased person which would have been lawful if this Act had not been passed. (2) Any authority for the removal of eyes given in accordance with the provisions of this Act shall not be deemed to be contravention of the provisions of Section 297 of the Indian Penal Code. SECTION 08: AMENDMENT OF BOM. XI OF 1949 In the Bombay Anatomy Act, 1949- (a)in the long title and preamble after the words "teaching institutions" the words "for therapeutic purposes or" shall be inserted ; (2) in section 2, in clause (1), for the words "to carry on anatomical examination and dissection" the words "for all or any of the purposes of this Act;" shall be substituted; (3) in section 5, in sub-section (1), after the words "approved institution" words "for any therapeutic purpose or" shall be inserted. Where admission of a patient to a hospital, nursing home or other institution is sought for, the person in charge of admission of the patient to such hospital, nursing home or other institution shall impress on the patient or, if the patient is incapable of making a judgment, the person accompanying the patient, the implication and necessity of donation of the eyes of the patient to be used for therapeutic purposes in the event of death of the patient. A prescribed form of request shall be presented for signature of the patient or the person accompanying him. The form of request signed by the person accompanying the patient shall be deemed to have been signed on behalf of the patient and shall have the same effect as if signed by the patient himself: Provided that it shall not be obligatory on the part of the patient or the person accompanying him to sign such a form for admission of the patient to the hospital, nursing.....

.....(i) by lineal consanguinity within three degrees or by collateral consanguinity within six degrees or (ii) by marriage with any of the relatives aforesaid. Explanation.- The expressions "lineal consanguinity" and "collateral consanguinity" shall have the meanings assigned to them in the Indian Sucession Act, 1925 (Central Act 39 of 1925), and degrees of relationship shall be computed in the manner laid down in that Act. (c) "prescribed" means prescribed by rules made under this Act. Removal of the eyes of deceased persons .-(1) If any person, either in writing at any time or orally in the presence of to or more persons during his last illness, has expressed an unequivocal request that his eye or eyes be used for therapeutic purposes after his death, the party lawfully in possession of his body after his death, may, unless, the said party has reason to believe that the request was subsequently withdrawn authorise the removal of the eye or eyes from the body for the use for those purposes.
