THE BOMBAY COTTON CONTROL ACT, 19421

PREAMBLE

An Act to provide for regulation and prohibition of the cultivation of any variety of cotton, of the mixing of the prohibited variety of cotton with other cotton and of the possession or use of, or trade in, the prohibited variety of cotton in any part of the 4[State of Maharashtra].

WHEREAS it is expedient in the best interests of the growers of cotton in certain areas in the 4[State of Maharashtra], the cotton trade and the economic prosperity of 5[the said State] to maintain the quality and reputation of the cotton grown in those areas, and for that purpose in such areas, to fix the variety of cotton to be grown, to prohibit the cultivation of any variety of cotton, to prohibit the mixing of the prohibited variety of cotton with any other cotton and to prohibit or restrict the possession or use of, or trade in, the prohibited variety of cotton;

NOTES

The Bombay Cotton Control Act, 1942, extended to the Bombay area of the State of Maharashtra. The corresponding law in force in Vidarbha was the Madhya Pradesh Cotton Control Act, 1954. There was no corresponding law in Marathwada area as the Hyderabad Cotton Cultivation and Transport Act, 1337-F, which was in force in that area was repealed by the Cotton Transport (Amendment) Act, 1960 (22 of 1960). In order to secure uniformity in the law relating to the regulation and prohibition of cultivation of certain varieties of cotton throughout the State of Maharashtra it was proposed to extend the Bombay Cotton Control Act, 1942, to the rest of the State and to repeal the corresponding law in force in Vidarbha.

It was also necessary to make some amendments to make the working of the Act more effective.

The Act is designed to achieve the above objects. - Statement of Objects and Reasons.
