The powers conferred on Courts by this Act shall be exercised only by the High Court, a Court of Session, 1[* * *] a salaried Presidency Magistrate, or a Magistrate of the first class and may be exercised by such Courts whether the case comes before them originally, or on appeal or in revision.

NOTES

Magistrate must direct detention of accused in a Borstal school for at least three years.- State of Maharashtra v. Krishna, Cr. R. No. 140 of 1970, dt. 8.10.1970 (H.C.).
