| THE UTTARAKHAND TECHNICAL UNIVERSITY (AMENDMENT) ACT, 2009 [Act No. 10 of 2010] PREAMBLE An Act further to amend the Uttaranchal Technical University Act, 2005 Be it enacted by the State Legislative Assembly in the Sixtieth Year of the Republic of India as follows-- Section 1 - Short title and commencement (1) This Act may be called the Uttarakhand Technical University (Amendment) Act, 2009. (2) It shall come into force at once. Section 2 - Substitution of "Uttarakhand" in place of "Uttaranchal" In the Uttaranchal Technical University Act, 2005 (Act No. 5 of 2005) hereinafter referred to as the principal Act, the word "Uttaranchal", wherever it occurs shall be substituted by the word "Uttarakhand". Section 3 - Renumbering of clauses after clause (d) of Section 2 After clause (d) of Section 2 of the principal Act, the clauses (e), (f), (g), (h), (i), (j), (k), (l), (m) and (n) shall be as renumbered in the Hindi version. Section 4 - Substitution of clause (b) of Section 2 and insertion of clause (o) after clause (m) In place of clause (b) of Section 2 of the principal Act, the following shall be substituted and clause (o) shall be inserted after clause (n), namely" "(b) Approved Institution' means an institution of Technical and Professional Education approved by the University/State Government". "(o) 'Professional Education' means B.Ed., M.Ed., Paramedical, Medical, B.P.Ed., Legal Education, research and training programmes and such other programmes or field declared to be such by Gazette Notification by the Central Government, in the consultation with Indian Ayurvedic Council, Indian Dental Science Council, Indian Pharmacy Council, National Teachers Training Council, University Grants Commission, Bar Council of India, Distance Education Council and other Regulatory Council related to Professional Education". Section 5 - Substitution of sub-section (1) of Section 4 In place of sub-section (1) of Section 4 of the principal Act, the following sub-section shall be substituted, namely" "The University shall for the purpose of exercising powers under this Act have the jurisdiction over the entire Uttarakhand in case of Technical Education and over Garhwal Division in the case of Professional Education". Section 6 - Substitution of sub-sections (a) and (h) of Section 6 In place of sub-sections (a) and (h) of Section 6 of the principal Act, the following sub-section shall be substituted, namely" "(a) To provide for an advancement in Technical and Professional Education, Training and Research and to create an atmosphere conducive to entrepreneurship in close co-operation with the Industry". "(A) To provide for an advancement in Technical and Professional Education, for the educationally backward classes and groups". Section 7 - Substitution of sub-section (1) of Section 17 In place of sub-section (1) of Section 17 of the principal Act, the following sub-section shall be substituted, namely--
Section 8 - Substitution of sub-section (1) of Section 20 In place of sub-section (1) of Section 20 of the principal Act, the following sub-section shall be substituted, namely" "(1) The Finance Committee shall comprise the following--
Section 9 - Substitution of sub-section (1) and (2) of Section 23 In place of sub-section (1) and (2) of Section 23 of the principal Act, the following sub-section shall be substituted, namely" "(1) For the purpose of effective co-ordination of Technical and Professional educational activities of the University set up in the State, particularly in relation to teaching, research, expansion of education and other similar activities and supervision over the academic and financial activities and programmes of the University, the State Government shall constitute a Council for Education and Research to be called the State Coordination Council for Technical and Professional Education. (2) The Council shall comprise the following members, namely" (i) Principal Secretary/Secretary to the State Government In-charge Higher Education, Medical Education, Agriculture and Law. (ii) Vice-Chancellors of G.B. Pant University of Agriculture and Technology,Kumaon University, Technical University. (iii) Principal Secretary/Secretary Department of Technical Education shall be the Convener of the Council. Section 10 - Substitution of sub-section (3) of Section 30 In place of sub-section (3) Section 30 of the principal Act, the following sub-section shall be substituted, namely" "30.(3) Notwithstanding anything contained in the foregoing sub-sections, the State Government may in order to implement any decision taken by it in the interest of learning, teaching or research on the basis of any suggestion or recommendation of the University Grants Commission or All India Council for Technical Education or other various Regulatory Councils related to Professional Education or the State or National Education Policy require the Executive Council to make new or additional regulation or amend or repeal the regulation referred to in sub-section (1) or (2) within the specified period and if the Executive Council fails to comply with such requirement within reasonable time the State Government may make new or additional regulation or amend or repeal the regulation referred to in sub-section (1) or sub-section (2).". Section 11 - Repeal and saving (1) The Uttarakhand Technical University (Amendment) Ordinance, 2009 (Uttarakhand Ordinance No. 3 of 2009) is hereby repealed. (2) Notwithstanding such repeal anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) of the Ordinance, shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by the Ordinance as if the provisions of this Ordinance were in force at all material times. | |||||||||||||||||||||||||||||||||||||||||||||
