An Act
to amend the Indian Ports Act, 1908, in its application to the Union territory of Pondicherry.
Be it enacted by the Legislative Assembly of Pondicherry in the Twentieth Year of the Republic of India as follows
:-

Short title, extent and commencement.
1. (1) This Act may be called the Indian Ports (Pondicherry Amendment) Act, 1969.
(2) It shall extend to the whole of the Union territory of Pondicherry.
1(3) It shall come into force on such date as the Government may, by notification in
the Official Gazette, appoint.

Substitution of new section for section 36.
2. For section
36 of the Indian Ports Act, 1908 (15 of 1908) (hereinafter referred to as the Principal Act), the following section shall be substituted, namel

1. The Act came into force from 26th January 1970 vide Extraordinary Gazette No. 10 dated 22nd January, 1970.

"36. (1) The Government shall appoint some officer or body of persons at every port at which any dues, fees or other charges are authorised to be taken by, or under, this Act, to receive the same.
(2) All money received under this Act at or on account of any port subject to this Act, including-
(a) receipts on account of pilotage;
(b) all fines
;
(c) proceeds of waifs
;
and
(d) any balance of the proceeds of a sale under section 14 where no right to the balance has been established on a claim made within three years from the date of the sale,
shall he credited to the Consolidated fund of the Union territory of Pondicherry.
(3) All expenses incurred for the sake of any such port, including expenses on account of pilotage, shall bepaid
from the Consolidated Fund of the Union territory of Pondicherry".

Omission of section 37.
3.
Section 37 of the principal Act shall. be omitted.
