| THE CODE OF CRIMINAL PROCEDURE (ORISSA AMENDMENT) ACT, 1970 [Published vide Orissa Gazette Ext. No. 568/22.5.1970-Nottn. No. 6006-Legis./20.5.1970.] PREAMBLE An Act to amend the Code of Criminal Procedure, 1898 in the application to the State of Orissa Be it enacted by the Legislature of the State of Orissa in the Twenty-first Year of the Republic of India, as follows : Section 1 - Short title and commencement (1) This Act may be called the Code of Criminal Procedure (Orissa Amendment) Act, 1970. (2) It shall come into force at once. Section 2 - Section 2 Amendment of Section 409, Act 5 of 1898 -In Section 409 of the Code of Criminal Procedure, 5 of 1898 to Sub-section (2), the following proviso shall be added, namely "Provided that where any such appeal is directed by State Government to be heard by an Additional Sessions Judge or Assistant Sessions Judge, that appeal may be preferred to him". |
