THE PAYMENT OF SALARIES AND ALLOWANCES

(AMENDMENT) ACT, 1994 [1]

(ACT 11 OF 1994)

An Act further to amend the payment of Salaries and Allowances Act, 1951.

Preamble.

WHEREAS

it is expedient further to amend the payment of Salaries and Allowances Act, 1951, for the purposes hereinafter appearing;

BE it enacted in the Forty-fifth Year of the Republic of India as follows:

1. Short title and commencement. "€(1) This Act may be called the Payment of Salaries and Allowances (Amendment) Act, 1994.

(2) It shall come into force at once.

2. Amendment of section 8. "€ In section 8 of the Payment of Salaries and Allowances Act, 1951 (XIV of 1951) (hereinafter referred to as the Principal Act), in sub-section (1), "€

(i) in clause (aa), for the words "eight hundred rupees" the words "one thousand and two hundred rupees" shall be substituted;

(ii) in the proviso to clause (b), for the words "two thousand rupees" the words "three thousand rupees" shall be substituted;

(iii) After the existing proviso, the following proviso shall be added, namely: "€

"Provided also that a member shall be free not to accept any benefit or the enhanced benefit under this sub-section, by intimating the Speaker in writing of his intention and thereupon the Speaker shall issue such instructions to the Legislature Secretariat as desired by the member".

3. Amendment of section 8A. "€ In section 8A of the principal Act, "€

(i) in sub-section (5), to the words "one thousand rupees" the words "two thousand rupees" shall be substituted;

(ii) to sub-section (5), the following proviso shall be inserted, namely: "€

"Provided that after the commencement of the Payment of Salaries and Allowances (Amendment) Act, 1994, it shall be lawful for the Government to enhance, by order, from time to time, the aforesaid allowance proportionate to the periodical increase in charges in respect of telephone made by the Central Government".

4. Amendment of section 9A. "€ In section 9 A of the principal Act, "€

(i) in sub-section (1), for the words "twenty-five thousand rupees", the words "thirty-five thousand rupees" shall be substituted;

(ii) to sub-section (1), the following proviso shall be inserted, namely: "€

"Provided that after the commencement of the Payment of Salaries and Allowances (Amendment) Act, 1994, it shall be lawful for the Government to enhance, by order, from time to time, the aforesaid amount of rail travel coupons proportionate to the periodical increase in rail charges made by the Central Government".

5. Amendment of the Schedule. "€ In the Schedule to the principal Act, in paragraph 1, "€

(i) in sub-clause (b) of clause (1), for the words "seventy-five rupees", the words "one hundred rupees" shall be substituted.

(ii) in sub-clause (b) of clause (2), for the words "one hundred rupees", the words "one hundred and fifty rupees" shall be substituted.
