THE HIMACHAL PRADESH SOCIETIES REGISTRATION (AMENDMENT) ACT, 2011

PREAMBLE
AN ACT further to amend the [Himachal Pradesh Societies Registration Act, 2006] (Act No. 25 of 2006).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-second Year of the Republic of India as follows:--

Section 1 - Short title
This Act may be called the Himachal Pradesh Societies Registration (Amendment) Act, 2011.

Section 2 - Amendment of section 1
In section 1 of the Himachal Pradesh Societies Registration Act, 2006 (hereinafter referred to as the "principal Act"), in sub-section(3), after clause (xii), the following clauses shall be inserted, namely:--
"(xiii) promotion of Sports, including in-door and adventure games but excluding games of chance and betting; and (xiv) any other charitable or welfare object as the State Government may, by notification published in the Official Gazette, notify.".

Section 3 - Amendment of section 8
In section 8 of the principal Act, for clause (xii), the following clause shall be substituted, namely:--
"(xii) the condition that the Society shall not distribute surplus, if any, among members,".

Section 4 - Amendment of section 9
In section 9 of the principal Act,--
(a) in sub-section (5), the words and signs "within a period of ninety days from the date of commencement of this Act" shall be omitted.; and
(b) the proviso to sub-section (5) shall be omitted.

Section 5 - Amendment of section 35
In section 35 of the principal Act, in sub-section (2), in second proviso, for the words "five lac", the words "twenty lac" shall be substituted.

Section 6 - Amendment of section 42
In section 42 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:--
"(1) If any dispute arises among the governing body or the members or ex-members of the Society or its employees or ex-employees in respect of any matter relating to the affairs of the Society, any member or ex-member of governing body or employee or ex-employee of the Society may refer such dispute to the Registrar for decision, who may either decide the dispute himself or refer such dispute to any other officer of the Government for disposal, as may be authorized by him in this behalf."
