| THE HARYANA DEVELOPMENT AND REGULATION OF URBAN AREAS (AMENDMENT) ACT, 2009 [Act No. 5 of 2009] PREAMBLE AN ACT Further to amend the Haryana Development and Regulation of Urban Areas Act, 1975. Be it enacted by the Legislature of the State of Haryana in the Sixtieth Year of the Republic of India as follows:-- Section 1 - Short title This Act may be called the Haryana Development and Regulation of Urban Areas (Amendment) Act, 2009. Section 2 - Amendment of section 2 of Haryana Act 8 of 1975 In sub-clause (v) of clause (c) of section 2 of the Haryana Development and Regulation of Urban Areas Act, 1975 (hereinafter called the principal Act), for the words and sign "to be notified by Government for the purposes of this sub-clause", the words "by Government" shall be substituted. Section 3 - Amendment of section 3 of Haryana Act 8 of 1975 In section 3 of the principal Act,-- (i) in sub-section (4), for the words "two years" and "one year", the words "four years" and "two years" shall respectively be substituted ; (ii) for sub-section (5), the following sub-section shall be substituted, namely:-- "(5) Each colony may comprise of one or more licences with contiguous land pockets.". Section 4 - Amendment of section 3A of Haryana Act 8 of 1975 In section 3-A of the principal Act,-- (i) for sub-section (6), the following sub-section shall be substituted, namely:-- "(6) The amount of infrastructure development charges so deposited by the colonizer shall constitute a fund, called the Fund for stimulating socio-economic growth and development of major infrastructure projects for the benefit of the State of Haryana (hereinafter referred to as the Fund)."; (ii) for sub-section (9), the following sub-section shall be substituted, namely:-- "(9) The Fund shall be utilized for stimulating socioeconomic growth and development of major infrastructure projects for the benefit of the State of Haryana. The Fund may also be utilized to meet the cost of administering the Fund.". |
