The agenda of CAG audit of discoms(the three entities formed by public private partnership model) is pending in a high court. And then looking at the severe criticisms of the functioning of discoms a cabinet meeting is called with the agenda of CAG audit of discoms. So this move is criticised by the discoms saying that the same issue is pending adjudication before the Hon'ble Delhi High Court, thus the cabinet should not take any action in this regard. Despite this the cabinet meeting took place and it was unanimously decided to order a CAG audit of discoms. Therefore my question is that can the state government take an action on an issue which is pending before a high court or supreme court?
