in the high court of jharkhand at ranchi a.b.a. no.3743 of 2012 ---- pinki devi .... .... ... ... .... petitioner ---versus--- the state of jharkhand .........opposite party ---- coram: hon'ble mrs.justice jaya roy ---- for the petitioner : mr. awnish shankar, advocate for the state : a.p.p. ---- 3 / 19.12.2012 heard the counsel for the petitioner and the counsel for the state. the petitioner is accused in this case registered under sections 414/ 34 of the i.p.c. and section 30(ii) of the coal mines act and section 33 of the indian forest act, pending in the court of c.j.m., hazaribagh. counsel for the petitioners has submitted that the petitioner is a lady aged about 30 years and she is pregnant and her expected date is 5.2.2013 and to support her contention she has annexed certain medical prescriptions in supplementary affidavit as annexure -1 series. counsel for the state has opposed but not disputed the aforesaid contentions of the counsel for the petitioner. considering the fact that the petitioner is pregnant at present and she is expecting her date in the month of february, 2013, and considering this aspect, only for granting anticipatory bail, i direct the petitioner above named, to surrender before the trial court /court below within a period of one month from the date of this order. if the petitioner surrenders before the court below/trial court within the said period, the trial court /court below is directed to release the petitioner namely pinki devi on bail, on furnishing bail bond of rs.10,000/- (rupees ten thousand) with two sureties of the like amount each, to the satisfaction of c.j.m., hazaribagh, in connection with hazaribagh (sadar) p.s.case no.706 of 2012, corresponding to g.r. no.3625 of 2012, subject to the conditions that one of the bailors will be local resident having immovable property within the jurisdiction of the district concerned and also subject to the conditions as laid down under section 438(2) cr.p.c.
