ORDER

This petition has been filed seeking to accept the cause title as the first defendant has not been impleaded as party in the second appeal on the ground that he is no more.

2. The petitioners/defendants 2 to 4 failed to implead the L.Rs of the first

defendant in the second appeal. Without impleading the L.Rs of the first defendant, the petitioners are not entitled to get along with the second appeal, as the suit was filed for partition. Therefore, this court is not inclined to entertain this petition and accordingly, this civil miscellaneous petition is dismissed.
