patna high court cr.misc. no.1108 of 2012 (2) dt.23-01-2012 in the high court of judicature at patna criminal miscellaneous no.1108 of 2012 ====================================================== yadu bind .... .... petitioner. versus the state of bihar .... .... opposite party. ====================================================== coram: honourable mr. justice dinesh kumar singh oral order (per: honourable mr. justice dinesh kumar singh”23. 01-2012 heard learned counsels for the petitioner, informant and the state. the petitioner is languishing in custody since 29.11.2010 in a case registered for the offence under sections 341, 307/34 of the indian penal code and 27 of the arms act. the accusation against the petitioner is of causing fire arm injury on the chest of the informant. injury has been found to be grieveous. it is contended by learned counsel for the petitioner that fardbeyan has been recorded half an hour prior to the time of occurrence as claimed by the informant. it is further submitted that the petitioner was at pathankoth at the relevant time of occurrence which is certified by sarpanch which gets corroborated from the fact that father of petitioner filed a complaint before the sarpanch two months prior to occurrence when it was patna high court cr.misc. no.1108 of 2012 (2) dt.23-01-2012 admitted that the petitioner was outside of state. both sides are agnates and there is serious land dispute between the parties. it is submitted by the informant that the petitioner has caused grievous injury on the chest. considering the accusation in the background of serious land dispute, let the petitioner above named be released on bail on furnishing bail bond of rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned c.j.m., lakhisarai in connection with piri bazar p.s. case no. 46 of 2010 on deposit of rs. 15,000/-(fifteen thousand) by the petitioner before the learned court below which will be released in favour of the informant by the learned court below. the bail bond of petitioner will be accepted on deposit of rs. 15,000/-(fifteen thousand) by the petitioner before the learned court below. 23. 01-2012 Heard learned counsels for the petitioner, informant and the State.
