in the high court of judicature at patna criminal miscellaneous no.2022 of 2012 subash rai versus the state of bihar ---------------------------------- with criminal miscellaneous no.3323 of 2012 rajesh rai versus the state of bihar ---------------------------------- 2/ 23.1.2012 heard learned counsels for the petitioners and the state. the petitioners are apprehending arrest in a case registered under sections379 and 420/34 of the indian penal code. it is alleged that the informant gave his atm card for withdrawal of money to one ajit singh, who was the guard at the atm booth. subsequently, the informant came to know that rupees three lac fifty nine thousand eight hundred were withdrawn from his account and ajit singh changed his atm card. it appears that subsequently ajit singh returned the entire amount to the informant and has been granted regular bail. considering the fact that the thrust of accusation is against ajit singh, let the above named petitioner be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing the bail bond of rs.10000/(ten thousand) with two 2 sureties of the like amount each to the satisfaction of c.j.m. saran at chapra in sonepur p.s. case no. 200 of 2011 subject to the conditions as laid down under section 438(2) of the cr.p.c. anil/ (dinesh kumar singh, j.)

It is alleged that the informant gave his ATM Card for withdrawal of money to one Ajit Singh, who was the guard at the ATM booth. Subsequently, the informant came to know that Rupees three lac fifty nine thousand eight hundred were withdrawn from his account and Ajit Singh changed his ATM card. It appears that subsequently Ajit Singh returned the entire amount to the informant and has been granted regular bail. Considering the fact that the thrust of accusation is against Ajit Singh, let the above named petitioner be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing the bail bond of Rs.10000/(ten thousand) with two 2 sureties of the like amount each to the satisfaction of C.J.M.
