19. 01-2012 Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 504 and 353/34 of the Indian Penal Code and Section 135 of the Electricity Act. It is alleged that on complaint it was found that the petitioners and his son not only damaged the transformer but also consumed the electricity illegally and also assaulted the electricity mechanic. It is submitted by learned counsel for the petitioners that they are the bona fide consumer and there is no seizure from the petitioners reflecting the committing of electricity theft and two sons of petitioners who are made accused are absolutely handicapped. The averments made in the F.I.R. reflect that no seizure was made which somehow supports the contention of the petitioner. Considering the aforesaid facts, let the above named Patna High Court Cr.Misc. No.1809 of 2012 (2) dt.19-01-2012 2/2 petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing the bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Presiding Officer, Special Court, P.E.S.U., Patna in connection with Kankarbag P.S. Case No. 372 of 2011 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Amrendra (Dinesh Kumar Singh, J.)
