in the high court of jharkhand at ranchi b.a. no. 1019 of 2013 manoj prasad ..... petitioner versus the state of jharkhand . opposite party coram: honble mr. justice h. c. mishra for the petitioner :mr. mohit prakash for the state :a. p.p. ----- 04/06.03.2013 heard learned counsel for the petitioner and learned a.p.p. for the prosecution. petitioner has been made accused for the offence under sections 366a, 120b/34 of the indian penal code, in connection with gumla p.s. case no. 55 of 2012, corresponding to g.r. no. 192 of 2012. there is allegation against the petitioner to have kidnapped the minor daughter of the informant. the statement of the victim girl has been recorded under section 164 of the cr.p.c., wherein, she has disclosed her age to be 16 years and she has stated that she is in love with the petitioner, she has married the petitioner and she wants to live with the petitioner. she was also stated that she was not kidnapped by the petitioner. in the facts and circumstances of the case, i am inclined to release the petitioner on bail. accordingly, the petitioner manoj prasad is directed to be released on bail, on furnishing bail bond of rs.10,000/- (rupees ten thousand) with two sureties of like amount each to the satisfaction of learned chief judicial magistrate, gumla, in connection with gumla p.s. case no. 55 of 2012, corresponding to g.r. no. 192 of 2012.
