hon'ble mr. george paracken, judicial member the applicant has filed this oa seeking a direction to the respondents 3 to 6 to forthwith arrange to pay the applicant's salary/leave salary for the month of september 2009 and also to arrange to release the advance of ta/da, advance pay etc. as requested for in annexure a-13. he has also sought a direction to respondents to treat the entire period from 12 october 2009 up to the date he is relieved to delhi in accordance with law as duty with all consequential benefits of pay and allowance arising there from. today, when the matter was taken up for hearing, the applicant has moved a ma-892/09 seeking permission to withdraw the oa with liberty to take up the matter with the department. accordingly, ma is allowed and oa is dismissed as withdrawn. there shall be no orders as to costs.

HON'BLE Mr. GEORGE PARACKEN, JUDICIAL MEMBER

The applicant has filed this OA seeking a direction to the respondents 3 to 6 to forthwith arrange to pay the applicant's salary/leave salary for the month of September 2009 and also to arrange to release the advance of TA/DA, advance pay etc. as requested for in Annexure A-13. He has also sought a direction to respondents to treat the entire period from 12 October 2009 up to the date he is relieved to Delhi in accordance with law as duty with all consequential benefits of pay and allowance arising there from.

Today, when the matter was taken up for hearing, the applicant has moved a MA-892/09 seeking permission to withdraw the OA with liberty to take up the matter with the department. Accordingly, MA is allowed and OA is dismissed as withdrawn.

There shall be no orders as to costs.
