Having heard the learned counsel appearing for the parties and considering the averments made in this application, we are satisfied that sufficient reasons have been furnished and adequate grounds have been mentioned for condo nation of delay in preferring the appeal.
Therefore, the delay in preferring the appeal is condoned. Department is directed to register the appeal if the same is otherwise in form. This application is disposed of. There will be no order as to costs. Re. G.A. 2615 of 2010 This application for stay has been filed in connection with the appeal preferred from the judgment and order dated 30th April, 2010 whereby and where under a learned Judge of this Court disposed of several writ petitions including the writ petition filed by the appellants herein being W.P.No.1352 of 2007.
Having heard the learned counsel of the respective parties and considering the facts and circumstances of the case, we are of the opinion that the issues raised in the appeal should be decided expeditiously and there is no scope to pass any interim order at this stage. Therefore, the appellants are directed to prepare requisite numbers of informal paper book out of Court and file the same within two weeks from date.
Since the respondents are represented by the learned Advocate, requirements of service of notice of appeal and all other formalities stand dispensed with.
Parties herein will be at liberty to apply for hearing of the appeal before the regular Bench immediately after filing of the paper books. This application stands disposed of. There will be no order as to costs.
