The father of the petitioner, who was an employee of C.I.S.F, retired on 1.2.1990 on medical ground of invalidation. As per the C.I.S.F Circular No.21/2005/R&S dated 14.6.2005, the wife, son and daughter of personnel, who is medically invalid will be entitled to be appointed on compassionate ground. Since petitioner's father was retired on the ground of invalidation on 1.2.1990, the petitioner claims appointment on compassionate ground in terms of the said circular. From the record, it is apparent that the date of birth of the petitioner was 22.11.1988. The age of the petitioner on the date of retirement of his father was nearly 2 years. His father died on 20.5.1996, on that date also the petitioner was a minor and was aged about 8 years. Counsel for the petitioner submits that only after attaining majority, the petitioner had applied for grant of compassionate appointment which was rejected. It is admitted that father of the petitioner was retired on medical ground of invalidation on 1.2.1990. It is also admitted that father of the petitioner died on 20.5.1996. As per the admitted case of the petitioner, date of birth of the petitioner is 22.11.1988, which means the petitioner was 8 years approximately at the time of death of his father. The petitioner has relied upon Circular No.21/2005/R&S dated 14.6.2005. Clause (iii) of the said Circular reads as follows: (iii) Before, forwarding the application to the Zonal/ Plant, DIsG, all the information as stipulated in the application will be personally verified by the Unit Commander. The forwarding letter to the Zonal/ Plant DisG will be signed personally by the Unit Commander. All the documents to be, enclosed along with the forwarding letter will be signed and stamped by the Unit Commander and the stamp should bear his name and rank. Only in the absence of the Unit Commander, this proforma can be forwarded by another GO, after verifying all these documents and observing all these formalities. As per the said circular, dependent member if he is a minor at the time of death of the deceased is allowed to apply for compassionate appointment on attaining the age of 18 years, provided he is due to attain the required age limit within five years from the date of death of Government Servant. Applying the said rule, it is crystal clear that the petitioner did not attain the required age limit within five years from the date of death of the Government Servant. That being the admitted position, the petitioner was not eligible to apply for grant of compassionate appointment. Counsel for the petitioner submits that the impugned order is on different ground, i.e, the petitioner is not eligible because of his height which is lesser than the minimum requirement for appointment as a constable. The petitioner claims that he was not praying to be appointed as a constable but he was claimed to be appointed for 'follower' for which no physical criteria is required. Be whatever as it may, since as per clause (v), referred to above, itself the petitioner even not eligible to apply, it hardly against on what ground the case of the petitioner has been rejected. Further the petitioner has survived for nearly 21 years from the date of death of his father. I find no reason to entertain this writ application and hence, this writ application is dismissed.
