ORDER

This is an application for anticipatory bail.

2. The petitioners are accused Nos 1 to 4 in Crime No. 1019 of 2020 of

Sreekaryam Police Station, Thiruvananthapuram City, which was registered alleging commission of offence under Section 420 r/w Section 34 of the Indian Penal Code .

3. The allegation against the petitioners is that they obtained money

from the de facto complainant on the promise of completing construction of a building for the de facto complainant and thereafter, they failed to complete the construction.

4. The learned counsel for the petitioners submits that even assuming

that all the allegations in the complaint given by the de facto complainant against the petitioners are true, the dispute is purely of civil nature and the criminal law could not have been set in motion. It is submitted that, at any rate, custodial interrogation of the petitioners is not necessary for the purpose of any investigation.

5. I have heard the learned Public Prosecutor also. The learned Public

Prosecutor submits that the case is under investigation. It is submitted that going by the complaint given by the de facto complainant, huge amounts of money were received by the ..4.. petitioners and thereafter, they failed to complete the construction of the building for the de facto complainant.

6. Though the de facto complainant is a party to this application, considering the nature of the allegations raised, I do not deem it necessary to issue notice to the de facto complainant.

7. Having regard to the facts and circumstances of the case and prima

facie being convinced that even if the entire allegations in the First Information Statement are true, the dispute is purely of civil nature, I am of the view that the petitioners can be granted anticipatory bail subject to conditions. In the result, this application is allowed and it is directed that the petitioners shall be released on bail, in the event of their arrest in connection with Crime No. 1019 of 2020 of Sreekaryam Police Station, Thiruvananthapuram City, subject to the following conditions:

(a) Petitioners shall execute separate bonds for a sum of Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the jurisdictional court.
