(oral) learned counsel for the petitioner submits that the petitioner was not named in the fir and was apprehended about 13 days after the incident. he further submits that as regards the other three cases registered against the petitioner, they are all shown to be registered within a span of 15 days and all are of the same nature. hence, the possibility of untraced thefts having been foisted on to the petitioner cannot be ruled out after he was caught in this case. keeping in view the above circumstances and the fact that all the four firs.information reports have been registered within a span of 14 days, all of them relating to petty thefts, and there is no other case registered against the petitioner at any earlier point of time, i deem it appropriate to admit the petitioner criminal miscellaneous no.m-19443 of 2014 2 to bail, upon his furnishing adequate bail/surety bonds to the satisfaction of the chief judicial magistrate/duty magistrate, fazilka. the matter be put up again before this court after the filing of the report under section 173, code of criminal procedure. the senior superintendent of police, fazilka, is directed to inform the registry of this court with regard to the filing of the report under section 173 of the code of criminal procedure, as and when it is filed in the competent court, to enable the registry to put up the matter for hearing. june5 2014 (amol rattan singh) kang judge

(Oral) Learned counsel for the petitioner submits that the petitioner was not named in the FIR and was apprehended about 13 days after the incident.

He further submits that as regards the other three cases registered against the petitioner, they are all shown to be registered within a span of 15 days and all are of the same nature.

Hence, the possibility of untraced thefts having been foisted on to the petitioner cannot be ruled out after he was caught in this case.

Keeping in view the above circumstances and the fact that all the four FiRs.Information Reports have been registered within a span of 14 days, all of them relating to petty thefts, and there is no other case registered against the petitioner at any earlier point of time, I deem it appropriate to admit the petitioner Criminal Miscellaneous No.M-19443 of 2014 2 to bail, upon his furnishing adequate bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Fazilka.
