After arguing at length the petitioner states that he would be satisfied if requisite time is granted to him to vacate the premises. He further states that he is making alternative arrangement by constructing his house. He also states that he has minor children and would require sufficient time to carry out the construction. Learned counsel for the respondent, who is on caveat, states on instructions that he has absolutely no objection if time is granted to the petitioner. Having regard to the consensual approach of the parties, I deem it appropriate to dispose of the instant petition directing the petitioner to furnish an undertaking within two weeks from today before the learned Rent Controller in the following terms :- 1. That he shall hand over physical vacant possession of the premises to the respondent on or before 31.3.2016.

2. That he shall pay all arrears of rent/mesne profits as Singh Daljit 2014.07.02 09:40 I attest to the accuracy of this document CR No.4165 of 2014 (O&M) -2- determined by the learned Appellate Authority upto date to the respondent within two weeks.

3. That he shall continue to make payment of rent/mesne profits by the 7th of each month till the physical vacant possession of the demised premises is handed over to the respondent.

4. That he shall not commit any default in payment of arrears of rent or the monthly rent/mesne profits and that even a single default will disentitle them to the benefit of this order.

5. That if the arrears of rent or the monthly rent/mesne profits is not paid as aforesaid, the landlord shall be entitled to execute the eviction order forthwith.

6. That the physical vacant possession of the demised premises shall be handed over to the landlord in the condition as it exists today.
