By Miscellaneous Order No. 42030/2013 dated 5.8.2013, the appellant was directed to predeposit a sum of Rs. 40 lakhs. The appellant filed CMA before the Honble Madras High Court. By order/judgment dated 4.12.2013 in CMA No.3308/2013 and M.P. No.1/2013, the Honble High Court extended the period of compliance of the miscellaneous order passed by the Tribunal by six weeks from the date of its order. The learned counsel submits that the appellant failed to predeposit the amount due to acute financial crisis. In view of that the appeal is dismissed for non-compliance of the order/judgment dated 4.12.2013 of the Honble High Court.
