crm no.m-17960 of2014o&m) -1- in the high court of punjab and haryana at chandigarh crm no.m-17960 of2014o&m) decided on : 04.06.2014 bholi ...petitioner versus state of punjab ...respondent and crm no.m-17980 of2014jaspal kaur @ palo ...petitioner versus state of punjab ...respondent coram : hon'ble mr.justice s.s.saron present : mr.nandan jindal, advocate, for the petitioner(s).mr.k.s. pannu, dag, punjab.s.s. saron, j. this order will dispose of two petitions bearing crm no.m-17960 of 2014 filed by bholi and crm no.m-17980 of 2014 filed by jaspal kaur @ palo, as these arise out of the same fir. heard learned counsel for the parties. bhatia shalini 2014.06.05 14:59 i attest to the accuracy and integrity of this document high court chandigarh crm no.m-17960 of2014o&m) -2- the petitioners are seeking regular bail in a case registered against them vide fir no.79 dated 14.04.2014 under sections 379/379-b/411 of the indian penal code, registered at police station civil lines patiala, district patiala. the fir has been registered at the instance of asi ranjit singh mamura, cia staff, patiala, who has stated that he along with other police officials was on patrolling duty for checking suspicious persons. they were present at sewa singh thikriwala chowk, patiala. a secret information was received there that gejo w/o nand singh, palo w/o darshan singh (petitioner in crm no.m-17980 of 2014).pammi w/o nishan, bholi w/o raji (petitioner in crm no.m-17960 of 2014) and another unknown lady, besides, balbir singh @ sonu had formed a gang in connivance with each other and they indulged in snatching of gold ornaments, which they used to sell to the goldsmith namely balbir singh @ sonu, who after purchasing the said gold ornaments at lessor rates, converted them to other ornaments and sold them in the market at higher rates. if immediate raid was conducted, the gang could be caught red handed. the information was found credible and fir was registered. the petitioners bholi and jaspal kaur @ palo have since been arrested and recoveries have been effected from them. from bholi (petitioner in crm no.m-17960 of 2014) and her co-accused paramjit kaur @ pammi, 8-½ tolas of gold bhatia shalini 2014.06.05 14:59 i attest to the accuracy and integrity of this document high court chandigarh crm no.m-17960 of2014o&m) -3- ornaments were recovered, whereas from jaspal kaur @ palo, 9 tolas and 8 gms (98 gms.gold was recovered. the trial in the case is likely to take time. balbir singh @ sonu, who is co-accused of the petitioners.has already been granted the concession of regular bail vide order dated 27.05.2014 passed by this court in crm no.m-17580 of 2014. there are other cases registered against the petitioners.however, according to learned counsel for the petitioners.those cases have been registered after the petitioners were arrested in the present case and on the basis of their alleged disclosure statements, the other cases were registered. keeping in view the facts and circumstances of the case, it would be just and expedient that the petitioners are granted the concession of regular bail. consequently, both the petitions are allowed and the petitioners namely bholi and jaspal kaur @ palo, on their furnishing personal bonds and surety each to the satisfaction of learned chief judicial magistrate/duty magistrate, patiala, shall be released on bail. june04 2014 (s.s.saron) shalini judge bhatia shalini 2014.06.05 14:59 i attest to the accuracy and integrity of this document high court chandigarh

This order will dispose of two petitions bearing CRM No.M-17960 of 2014 filed by Bholi and CRM No.M-17980 of 2014 filed by Jaspal Kaur @ Palo, as these arise out of the same FIR.

Heard learned counsel for the parties.

Bhatia Shalini 2014.06.05 14:59 I attest to the accuracy and integrity of this document High Court Chandigarh CRM No.M-17960 OF2014O&M) -2- The petitioners are seeking regular bail in a case registered against them vide FIR No.79 dated 14.04.2014 under Sections 379/379-B/411 of the Indian Penal Code, registered at Police Station Civil Lines Patiala, District Patiala.

Consequently, both the petitions are allowed and the petitioners namely Bholi and Jaspal Kaur @ Palo, on their furnishing personal bonds and surety each to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Patiala, shall be released on bail.
