RAKESH KUMAR GARG, J This is defendant's second appeal challenging the judgments and decrees of the Courts below whereby suit of the plaintiff-respondent for specific performance of the agreement to sell in question has been decreed by both the Courts below.

Suffice is to say that both the Courts below on appreciation of evidence have recorded a concurrent finding that agreement to sell in question was duly and validly executed by the appellant in favour of the plaintiff-respondent and has received earnest money.

The Courts below have further found that plaintiff- respondent ever remained ready and willing to perform his part of the contract.
