in the high court of punjab & haryana at chandigarh cwp no.18521 of 2010 date of decision:23.05.2014 ram niwash ....petitioner versus state of haryana & others ......respondents coram: hon'ble mr.justice g.s.sandhawalia present: mr.naveen sharma, advocate, for the petitioner. mr.kshitij sharma, aag, haryana. g.s.sandhawalia j.(oral) challenge in the present writ petition is for quashing the appointment made by respondents no.1 to 3 on the basis of the result declared on 29.01.2008 (annexure p2) regarding the advertisement no.6/2007 dated 21.06.2007, in the newspaper. the said selection was also the subject matter of challenge in a bunch of cases, the lead case of which was cwp no.6485 of 2008 titled suresh kumar & others versus state of haryana & others decided on 09.01.2014. the present case was admitted, to be heard with cwp no.6199 of 2008 titled suman baghla & others versus state of haryana & others.the said writ petition was decided with cwp no.6485 of 2008. the challenge was repelled by this court and the said writ petitions were dismissed. the reasoning reads as under: “another reason which disentitles the petitioners to the claim as made by them is that the challenge to the criteria at the stage when the selection has proceeded with in which the petitioners have taken a chance and failed. they cannot be permitted to challenge the criteria at this stage as they should have agitated this cause at the initial stage. having taken a chance, they cannot now be allowed to turn around and lay a challenge to it as they would be estopped to do so. in view of the above, finding no merit in the present writ petitions, the same stand dismissed.”. accordingly, keeping in view the above said observations, the present writ petition is also dismissed. 23.05.2014 sailesh ranjan (g.s.sandhawalia) 2014.05.27 10:40 sailesh i attest to the accuracy and judge integrity of this document

G.S.Sandhawalia J.(Oral) Challenge in the present writ petition is for quashing the appointment made by respondents No.1 to 3 on the basis of the result declared on 29.01.2008 (Annexure P2) regarding the advertisement No.6/2007 dated 21.06.2007, in the newspaper.

The said selection was also the subject matter of challenge in a bunch of cases, the lead case of which was CWP No.6485 of 2008 titled Suresh Kumar & others versus State of Haryana & others decided on 09.01.2014.
