19. 5/2014 2/3 1. The petitioners herein have claimed promotion from the post of Constable to the post of Head Constable in the respondent – Police Department.

2. The learned counsel for the petitioner during the course of arguments submitted that during the pendency of the writ petition, upon an application under the Right to Information Act, 2005, the petitioners were supplied the copy of respective marksheets for the written examination held for said promotion. Upon receiving the marksheets, they have come to know that marking in the written test is proper. However, for the interview and other out-door test etc., the marks have not been properly awarded by the respondents.

3. The learned counsel for the respondents submitted that the petitioners failed to secure minimum marks and the mark-sheets produced by the petitioner clearly shows that the petitioners could not succeed in the said examinations for promotion to the post of Head Constable. The learned counsel for the respondents also pointed out that in similar circumstances, the writ petition of one of the petitioners – Rati Ram bearing SBCWP No.10590/2013 – Rati Ram V/s State and ors. has been dismissed by this Court on 25.4.2014 on the ground that the petitioner failed to secure minimum marks. However, the learned counsel for the petitioners still pressed the present writ petitions.

4. In the circumstances of the case, these writ petitions are S.B. Civil Writ Petition No.3685/2013 Dhanna Ram V/s State of Rajasthan and ors. and 9 connected writ petitions. Order dt:

19. 5/2014 3/3 disposed of with a direction and liberty to the petitioner to file a suitable representation to the respondent – Inspector General of Police, Jaipur, who is expected to decide the said representation expeditiously and preferably after giving an opportunity of hearing to the petitioners within a period of three months from today. No order as to costs. A copy of this order be sent to the parties concerned forthwith. (Dr. VINEET KOTHARI), J.
