cwp no.26526 of 2013 -1- in the high court of punjab & haryana at chandigarh cwp no.26526 of 2013 date of decision:15.05.2014 krishma rani ....petitioner versus punjabi university, patiala & another ......respondents coram: hon'ble mr.justice g.s.sandhawalia present: mr.parminder singh, advocate, for the petitioner. mr.rahul sharma-i, advocate, for respondent no.2. ***** g.s.sandhawalia j.(oral) 1. present writ petition has been filed for seeking writ in the nature of mandamus for issuing directions to the respondents to issue the original certificates and detailed marks card to the petitioner, pertaining to the b.ed cours.for the session 2012. 2. the case of the petitioner, in brief, is that she was a regular student of one year b.ed cours.for the year 2011-12, with the respondent no.2-college, which is affiliated with respondent no.1-university and she appeared in the said degree cours.in april, 2012 and has passed her examination but has not received the original of the detailed marks card. it has been averred that the petitioner had approached the respondent-college seeking information as to why her result has been declared as rlr, despite the fact that she had deposited all the requisite documents but got no response. respondent no.1-university also issued a letter dated 02.07.2012 to respondent no.2-college vide which the university requested the college for providing the necessary relevant documents of the students including the petitioner having roll no.12718. sailesh ranjan 2014.05.19 10:28 i attest to the accuracy and integrity of this document cwp no.26526 of 2013 -2- 3. counsel for the petitioner has, accordingly, submitted that a period of almost 2 years has expired but the certificate has not been issued. 4. none has put in appearance on behalf of respondent-university, despite service, to rebut the claim that whether the petitioner has passed the said cours.or not or is not eligible for declaration of result. counsel for the petitioner has placed reliance upon annexure p3, the provisional intimation result, which goes on to show that the result has been withheld for some deficiency and it has substantiated the case of the petitioner that it is only on account of lack of documents, which might have to be furnished by the respondent no.2-college. counsel for respondent no.2-college undertakes that the college will forward the necessary documents, if any, to the respondent- university, within one week from today. it is directed that the respondent- university will, thereafter, declare the result and issue necessary certificates, within 2 weeks, thereafter, latest by 15.06.2014. 5. with the abovesaid directions, the present writ petition stands disposed of. 15.05.2014 (g.s.sandhawalia) sailesh judge sailesh ranjan 2014.05.19 10:28 i attest to the accuracy and integrity of this document

Present writ petition has been filed for seeking writ in the nature of mandamus for issuing directions to the respondents to issue the original certificates and detailed marks card to the petitioner, pertaining to the B.Ed CouRs.for the session 2012.

The case of the petitioner, in brief, is that she was a regular student of one year B.Ed CouRs.for the year 2011-12, with the respondent No.2-College, which is affiliated with respondent No.1-University and she appeared in the said Degree CouRs.in April, 2012 and has passed her examination but has not received the original of the detailed marks card.

It has been averred that the petitioner had approached the respondent-College seeking information as to why her result has been declared as RLR, despite the fact that she had deposited all the requisite documents but got no response.

Respondent No.1-University also issued a letter dated 02.07.2012 to respondent No.2-College vide which the University requested the College for providing the necessary relevant documents of the students including the petitioner having roll No.12718.

Counsel for the petitioner has, accordingly, submitted that a period of almost 2 years has expired but the certificate has not been issued.

None has put in appearance on behalf of respondent-University, despite service, to rebut the claim that whether the petitioner has passed the said CouRs.or not or is not eligible for declaration of result.

Counsel for the petitioner has placed reliance upon Annexure P3, the provisional intimation result, which goes on to show that the result has been withheld for some deficiency and it has substantiated the case of the petitioner that it is only on account of lack of documents, which might have to be furnished by the respondent No.2-College.

Counsel for respondent No.2-College undertakes that the College will forward the necessary documents, if any, to the respondent- University, within one week from today.

It is directed that the respondent- University will, thereafter, declare the result and issue necessary certificates, within 2 weeks, thereafter, latest by 15.06.2014.

With the abovesaid directions, the present writ petition stands disposed of.
