(Oral) This order shall dispose of the present petition filed under Section 439 Cr.P.C.seeking regular bail to the petitioner in case FIR No.178 dated 19.11.2013 under Section 22 of the Narcotic Drugs & Psychotropic Substance Act, 1985, registered at Police Station Sadar Kotkapura, District Faridkot.

Learned counsel for the parties have been heard.

It has gone undisputed that no recovery of any intoxicating material has been effected from the present petitioner.

It is not even the case of the prosecution that the petitioner had run away from the spot.

The recovery of 1,20,000/- tablets of Distil and 80 vials of RexCo.Syrup is from Gurpreet Singh and Raj Kumar @ Raju.

The petitioner is implicated in the present case on the basis of an alleged extra-judicial confession made before one Gurmit Singh.
