in the high court of punjab and haryana at chandigarh crm no.m- 41930 of 2013 (o&m) 211 date of decision : 14.03.2014 balwant singh @ billa .....petitioner versus state of punjab ....respondent coram:- hon'ble mr.justice m.m.s.bedi present: mr.johny goyal, advocate for the petitioner. mr.ankur jain, aag, punjab. **** m.m.s.bedi , j. the petitioner, who was allegedly found in possession of 1 kg heroine on 17.05.2012 has sought the concession of interim bail on the ground that he is not well and suffers from hcv +ve. the report has been received to the effect that the petitioner is suffering from pulmonary, disseminated, lymphadenitis, musculoskeletal and nervous system tuberculosis and had been suffering from fever, weakness and jaundice besides indigestion. learned state counsel has opposed the prayer, inter alia, on the ground that the petitioner is involved in another case of similar nature. it has been informed that he was sentenced to undergo imprisonment of two years in another case under ndps act. the petitioner has been in custody in the present case w.e.f.17.05.2012. taking into consideration the nature of aliment as per medical report submitted, the petitioner is granted concession of sharma ritu interim/temporary bail for a period of three months in order to get 2014.03.15 11:31 i attest to the accuracy and integrity of this document chandigarh crm no.m- 41930 of 2013 (o&m) -2- proper treatment. the petitioner will be released on interim/temporary bail subject to his furnishing bail/surety bonds to the satisfiction of the trial court. the petitioner would be required to surrender before the jail authority on 16.06.2014 subject to the additional condition that the petitioner will not commit the similar offence of which he is accused of. in case of any such eventually, this order will be deemed to have been withdrawn entitling the police to arrest the petitioner and send him behind bars prior to 16.06.2014. it is expected that the trial court would make an endeavour to conclude the trial expeditiously. disposed of. The petitioner, who was allegedly found in possession of 1 kg heroine on 17.05.2012 has sought the concession of interim bail on the ground that he is not well and suffers from HCV +ve.

The report has been received to the effect that the petitioner is suffering from Pulmonary, Disseminated, Lymphadenitis, Musculoskeletal and Nervous system tuberculosis and had been suffering from fever, weakness and Jaundice besides indigestion.

Learned State counsel has opposed the prayer, inter alia, on the ground that the petitioner is involved in another case of similar nature.

It has been informed that he was sentenced to undergo imprisonment of two years in another case under NDPS Act.

The petitioner has been in custody in the present case w.e.f.17.05.2012.
