oral order: per justice mr. s.b. mhase, honble president ld. counsel for the respondent states that in view of the provisions of section 24 of the consumer protection act, 1986, he may be allowed to withdraw the application dated 16/9/2009 below which the impugned order has been passed. he seeks liberty to agitate the issue involved in the said application by filing an appeal as against the order dated 24/3/2008 passed on application for interim relief by the mumbai suburban district consumer forum in consumer complaint no.157/2008. he further states that at this stage impugned order may be set aside. petitioner in person has no objection for such course. in view of this we pass following order:- order 1. impugned order is set aside. 2. application dated 16/9/2009 presented with the district consumer forum is allowed to be withdrawn with a liberty to file appeal under section 15 of the said act. 3. revision petition stands disposed of. 4. copies of the order be furnished to the parties.

Ld. counsel for the respondent states that in view of the provisions of section 24 of the Consumer Protection Act, 1986, he may be allowed to withdraw the application dated 16/9/2009 below which the impugned order has been passed. He seeks liberty to agitate the issue involved in the said application by filing an appeal as against the order dated 24/3/2008 passed on application for interim relief by the Mumbai Suburban District Consumer Forum in consumer complaint no.157/2008. He further states that at this stage impugned order may be set aside. Petitioner in person has no objection for such course. In view of this we pass following order:-

ORDER

1. Impugned order is set aside.

2. Application dated 16/9/2009 presented with the District Consumer Forum is allowed to be withdrawn with a liberty to file appeal under section 15 of the said Act.

3. Revision petition stands disposed of.

4. Copies of the order be furnished to the parties.
