(ORAL) Feeling aggrieved against the alleged inaction on the part of respondent authorities, the petitioner has approached this Court, by way of instant petition under Article 226/227 of the Constitution of India, seeking a writ in the nature of Mandamus.
Learned counsel for the petitioner submits that when the genuine grievance of the petitioner was not being redressed, he approached the respondent authorities by way of self contained representation dated 7.12.2012 (Annexure P-3).but the same is also pending decision.
He further submits that the petitioner will be satisfied in case respondent No.1 is directed to examine, consider and decide the representation of the petitioner by passing an appropriate order, keeping in view the textbooks, Annexures P-4 to P-6 as well as the judgment passed by the Hon'ble Supreme Court in Kanpur University and others versus Samir Gupta and others 1983 AIR (SC) 1230.

Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, including the issue of limitation, if any, Board of School Educaiton Haryana Bhiwani through its Secretary-respondent No.1 is directed to look into the grievance of the petitioner, which prima facie seems to be genuine and decide his representation dated 7.12.2012 (Annexure P- 3).by passing an appropriate order thereon, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order.
Respondent No.1 is further directed that while deciding the representation of the petitioner, decision of the Hon'ble Supreme Court referred to above as well as the textbooks Annexures P- 4 to P-6, shall be kept in view.
With the observations made above, the present petition stands disposed of.
