(oral) the petitioners seek a direction to the greater ludhiana area development authority (for short 'the glada').ludhiana to grant 'no objection certificate' on the basis of an application dated 10.6.2011 so as to enable petitioner no.2 to transfer the residential plot no.2021-c, phase-i, dugri road, ludhiana, in favour petitioner no.1. we find from the record that the above mentioned request made by the petitioners has not been considered by the estate officer, glada, ludhiana, only on the ground that non-construction charges are yet to be assessed. a communication to this effect has been sent to petitioner no.2 on 22.6.2012 (annexure p-12).learned counsel for the petitioners submits that the petitioners are willing to deposit non-construction charges in accordance with rules and delay in assessment of such charges should not be an impediment for not issuing the cwp no.2309 of 2013 [2].no objection certificate which is necessitated for lawful transfer of plot by petitioner no.2 in favour of petitioner no.1. the above stated plea taken on behalf of the petitioners appears to be just and fair. hence, without expressing any views on merits at this stage, we deem it appropriate to dispose of this writ petition with a direction to the chief administrator, glada and estate officer, glada, ludhiana to consider the request made by respondent no.2 to assess the non-construction charges, if any leviable by respondent no.2 and issue the requisite no objection certificate on deposit thereof. the needful shall be done within a period of two months from the date of receiving a certified copy of this order. in case the stamp papers purchased by the petitioners expire meanwhile, liberty is granted to them to seek renewal of such stamp papers.ordered accordingly. dasti. $ (surya kant) judge $ february 04, 2013 (r.p.nagrath) mohinder judge

(Oral) The petitioners seek a direction to the Greater Ludhiana Area Development Authority (for short 'the GLADA').Ludhiana to grant 'No Objection Certificate' on the basis of an application dated 10.6.2011 so as to enable petitioner No.2 to transfer the residential plot No.2021-C, Phase-I, Dugri Road, Ludhiana, in favour petitioner No.1.

We find from the record that the above mentioned request made by the petitioners has not been considered by the Estate Officer, GLADA, Ludhiana, only on the ground that non-construction charges are yet to be assessed.

A communication to this effect has been sent to petitioner No.2 on 22.6.2012 (Annexure P-12).Learned counsel for the petitioners submits that the petitioners are willing to deposit non-construction charges in accordance with rules and delay in assessment of such charges should not be an impediment for not issuing the CWP No.2309 of 2013 [2].No Objection Certificate which is necessitated for lawful transfer of plot by petitioner No.2 in favour of petitioner No.1.

The above stated plea taken on behalf of the petitioners appears to be just and fair.

Hence, without expressing any views on merits at this stage, we deem it appropriate to dispose of this writ petition with a direction to the Chief Administrator, GLADA and Estate Officer, GLADA, Ludhiana to consider the request made by respondent No.2 to assess the non-construction charges, if any leviable by respondent No.2 and issue the requisite No Objection Certificate on deposit thereof.

The needful shall be done within a period of two months from the date of receiving a certified copy of this order.
