(Oral) This petition is being entertained on a telegram made by Smt.

Sita wife of Shambhu Parshad that her husband has been taken by the police on 28.7.2012 and no case has been registered against him.

On notice, reply has been filed by Deputy Superintendent of Police, Pehowa, District Kurukshetra.

It has been stated that DDR No.22 dated 24.7.2012 was got lodged on a statement made by Gurpal Singh that his daughter Prabhdeep Kaur aged 22 years studying in M.A.Ist Crl.

Writ Petition No.1372 of 2012 (O&M) [ 2 ].Year was found missing from her house on 23.7.2012.

An inquiry was conducted and initially husband of the present petitioner Shambhu Parshad was called to the Police Station on 28.7.2012.

He came on 29.7.2012 along with one Alok Bahadur, who gave in writing that as and when Shambhu Parshad is required for interrogation, he will produce him before the police.

The police after following the call details of Mobile No.8950676432 which was of Mahadev who is son of Shambhu Parshad registered a FIR No.239 dated 7.8.2012 under Sections 363/366 IPC against Mahadev, Sita Devi and Shambhu Parshad (Annexure R-3).Petitioner and her husband were granted anticipatory bail by the Additional Sessions Judge, Kurukshetra, on 14.8.2012.

Thereafter, they joined investigation and during the couRs.of investigation it is stated that Prabhdeep Kaur had been taken by son of the complainant Mahadev to Nepal.

On an earlier occasion, the petitioner had given a telegram that her husband Shambhu Parshad has been taken away by the local police and this Court treated the said telegram as Criminal Writ Petition No.1409 of 2012 and disposed of this petition by observing that he had been called in the police station in FIR No.239 dated 7.8.2012 and thereafter he was released on bail.

The investigation qua son of the petitioner Mahadev is still pending and petitioner's husband Shambhu Prashad has not been taken into custody neither he has been released on Crl.

Writ Petition No.1372 of 2012 (O&M) [ 3 ].bail.

In view of the above, no further orders are required to be passed.

The petition is disposed of.
