Order dated 31.7.2012 passed by Additional Commissioner, Rewa Division, Rewa is being assailed.
Vide impugned order the appellate authority while affirming the order dated 3.7.2012 passed by Chief Executive Officer, Janpad Panchyat, Rampur Naikin and order dated 16.7.2012 passed by Chief Execution Officer, Jila Panchayat, Sidhi of allotting the work of distribution of middaymeal in Primary School, Mudia in favour of respondent No. 5 Indira Gandhi Mahila Swasahayata Samuh,has dismissed the appeal preferred by the petitioner.
Case of the petitioner is that the work of distribution of middaymeal in two schools, viz., Primary School Mudia and Middle School, Mudia was satisfactorily being carried out by the petitioner Self Help Group Since 2009 under the scheme floated by the State Government through Integrated Child Development Project providing nutritional food under Poshak Ahar Yojana to the satisfaction of the respondents. However, suddenly by order dated 3.7.2012 work of both the schools were taken away from the petitioner.
Whereagainst petitioner preferred an appeal before Commissioner, Rewa division, Rewa; whereon by order dated 16.7.2012 the operation of order dated 3.7.2012 was stayed on the basis whereof petitioner continued to discharge the work of distributing midday meal in both the 2 schools as per order dated 24.7.2012 passed by Chief Executive Officer, Janpad Panchayat, Rampur Naikin.
That, an appeal was also preferred by respondent No. 5 before Additional Commissioner, Rewa division, Rewa; wherein by order dated 20.7.2012 respondent No. 5 was allowed to perform till 31.7.2012.
Subsequent thereafter, it appeaRs. in order to resolve the controversy and to be in toe with the policy of the State Government of equal allotment of distribution of middaymeal amongst self help groups an order came to be passed on 16.7.2012 by Chief Executive Officer, Janpad Panchayat, Sidhi of bifurcating the two schools amongst the petitioner and respondent No. 5. Whereas, the petitioner was allotted the work for preparation of mid day meal of Middle School Mudia and respondent No. 5 was granted the work of Primary School, Mudia. It is accordingly urged that the order deserves to be set aside and work of both the schools be ordered to be restored to the petitioner.
Considered the submissions.
As gathered from the submissions and material on record that the scheme whereunder the middaymeal is to be provided has been brought in vogue stipulates that no compromise in respect of the quality of food to be provided to the children between the age of 3 to 6 years through Sajha Choolha under Poshak Ahar scheme.
And that the entire expenses are being meted out by the State Government and it is 4 only the agency who prepares the food at the respective places and supplies the same to the children in respective schools. The scheme lays down the standard which has to be meted out and maintained by self help groups which are selected to provide midday meal and nutritional food under Saja Choolha Scheme. Thus, it is the State Government which is the ultimate authority to select the self help group which could satisfactorily perform the function.
In the case at hand the bifurcation has been effected to achieve the optimum so that nutritional food is supplied to the children in the school. This action of the functionaries of the State Government is purely administrative and it is not that the petitioner has been blacklisted or that entire work of supply of mid day meal has been taken away from the petitioner.
In view whereof this Court does not find any illegality in the action of respondents nor any perversity in the order passed by the appellate authority as would warrant any interference. In view whereof petition fails and is dismissed. No costs.
