wp 3453.13 writ petition no.3453 of 2013 (ramkumar singh (deceased) through rambali singh and fix others v. sukhai (deceased) though arjun kol and two others.08-03-2013 shri b.k.singh, learned counsel for the petitioner. heard. order dated 04-09-2012 passed by board of revenue is being assailed vide this petition under article 227 of the constitution. by impugned order right of respondents, who are member of schedule tribe community over a piece of land being khasr.no.53, 54, 136, 135, 137, 138, 139, 824, 825, 826, 827, 829, 830, 831, 832, 833, 834, 835 and 52/1128 ad-measuring 17.19 acres situated at village khamharia, tehsil-rampur baghelan, district-satna, has been affirmed and the action taken by sub divisional officer under section 170-b of the madhya pradesh land revenue code, 1959, of restoring the land in favour of respondents has been upheld. claiming it to be the ancestral property respondents brought the proceedings under section 170-b of the 1959 code on the ground that though prohibited under section 165 (6) of the 1959 code the petitioners surreptitiously got patta of the subject property in their name. sub divisional officer drew proceedings forming subject matter of case no.2/v-23/97-98 which culminated into an order dated 06-11-2001 wherein the sub divisional officer on a finding that the original holder ramsahay kol, father of respondent sukhai kol (since deceased and is represented through his wp 3453.13 legal heirs.did not transfer the land in question and that the petitioner having failed to establish the “patta”. being issued in their favour directed for return of subject land. this order was affirmed by collector in appeal no.54/ v-23/02-03 which was dismissed on 11-08-2003 and in second appeal no.101/vihy/2009-10, dismissed on 28-02-2011 by the commissioner, rewa division, rewa. relevant finding in paragraph 3 of the order dated 28-02-2011, in absence of any material contrary to the same, leaves no iota of doubt that the land in question belonged to ramsahay kol whose rights of holding were protected under section 165 (6) of 1959 code which provides for : “(6) notwithstanding anything contained in sub- section (1) the right of bhumiswami belonging to a tribe which has been declared to be aboriginal tribe by the state government by a notification in that behalf, for the whole or part of the area to which this code applies shall - (i) in such areas as are predominately inhabited by aboriginal tribes and from such date as the state government may, by notification, specify, not be transferred not it shall be transferable either by way of sale or otherwise or as a consequence of transaction of loan to a person not belonging to such tribe in the area specified in the notification. (ii) in areas other than those specified in the notification under clause (i).not to be transferred or be transferable either by way of sale or otherwise or as a consequence of transaction of loan to a person not belonging to such tribe without the permission of a revenue officer not below the rank of collector, given for reasons to be recorded in writing. explanation.- for the purposes of this sub-section the expression “otherwise”. shall not include lease. wp 3453.13 (6-a) notwithstanding anything contained in sub- section (1).the right of a bhumiswami other than a bhoomiswami belonging to a tribe which has been declared to be an aboriginal tribe under sub-section (6).in the land excluding the agricultural land shall not be transferred or be transferable either by way of sale or otherwise or as a consequence of transaction of loan to a person not belonging to aboriginal tribe without the permission of the collector given for reasons to be recorded in writing: provided that every such transfer effected after the 9 day of june, 1980 but before the 20th april, th 1981 which is not in accordance with the provisions herein contained shall, unless such transfer is ratified by the collector in accordance with the provisions hereinafter contained, be void and shall be of no effect whatsoever, notwithstanding anything contained in this code or any other law for the time being in force. Heard.

Order dated 04-09-2012 passed by Board of Revenue is being assailed vide this Petition under Article 227 of the Constitution.

By impugned order right of respondents, who are member of Schedule Tribe Community over a piece of land being KhaSr.No.53, 54, 136, 135, 137, 138, 139, 824, 825, 826, 827, 829, 830, 831, 832, 833, 834, 835 and 52/1128 ad-measuring 17.19 acres situated at village Khamharia, tehsil-Rampur Baghelan, district-Satna, has been affirmed and the action taken by Sub Divisional Officer under section 170-B of the Madhya Pradesh Land Revenue Code, 1959, of restoring the land in favour of respondents has been upheld.

This order was affirmed by Collector in Appeal No.54/ v-23/02-03 which was dismissed on 11-08-2003 and in Second Appeal No.101/vihy/2009-10, dismissed on 28-02-2011 by the Commissioner, Rewa Division, Rewa.

That the petitioners having failed to prove as to how the land in question got transferred in their name, the findings were rightly upheld by the Revisional Court i.e.Board of Revenue by impugned order.
