05.09.2012. shri praveen verma for the petitioner. shri amit kumar sharma, panel lawyer, for the state on advance notice. petitioner is working as an assistant grade iii in tehsil office luvkush nagar, district chhatarpur and by the impugned order has been transferred from the present place to tehsil bijawar. similarly, one shri mohanlal kalawat was also transferred from chhatarpur to tehsil luvkush nagar in place of the petitioner, by an order passed on 13.7.2012. shri mohanlal kalawat, who was to come in place of the petitioner, challenged his transfer in writ petition no.12881/2012(s) and this court vide order passed on 23.8.2012, disposed of the writ petition directing the competent authority to consider the grievance of the petitioner therein, shri mohanlal kalawat, and decide his representation by a speaking order and till then he was permitted to work in his original place of posting at chhatarpur. petitioner also claims similar benefit on the ground that posting at luvkush nagar in place of the petitioner has already been stayed and, therefore, till representation of the petitioner is not decided, petitioner be permitted to work at the present place. keeping in view the aforesaid, it is directed that without entering into the controvers.on merits, respondents are directed to consider and decide the representation of the 2 petitioner in accordance with law within a period of four weeks from today and till then petitioner permitted to work at his present place of posting in tehsil luvkush nagar. with the aforesaid, the petition stands disposed of. certified copy as per rules. Petitioner is working as an Assistant Grade III in Tehsil Office Luvkush Nagar, District Chhatarpur and by the impugned order has been transferred from the present place to Tehsil Bijawar.

Similarly, one Shri Mohanlal Kalawat was also transferred from Chhatarpur to Tehsil Luvkush Nagar in place of the petitioner, by an order passed on 13.7.2012.

Shri Mohanlal Kalawat, who was to come in place of the petitioner, challenged his transfer in Writ Petition No.12881/2012(S) and this Court vide order passed on 23.8.2012, disposed of the writ petition directing the competent authority to consider the grievance of the petitioner therein, Shri Mohanlal Kalawat, and decide his representation by a speaking order and till then he was permitted to work in his original place of posting at Chhatarpur.

Petitioner also claims similar benefit on the ground that posting at Luvkush Nagar in place of the petitioner has already been stayed and, therefore, till representation of the petitioner is not decided, petitioner be permitted to work at the present place.
