Heard on I.A No.17472/12 an application for stay.

Learned counsel for the applicant submits that after receiving the lump sum amount from applicant some how respondent is delaying the proceedings of court for maintenance.

She has filed a criminal revision no.137/12 before the ASJ Rehli and learned ASJ Rehli vide order dated 25.7.2012 remanded the case for re-hearing and ordered to decide within one month.

She submits that if proceedings pending before JMFC Rehli are not stayed then this revision filed by the applicant shall become infructuous.

Looking to the facts and circumstances of the case I.A No.17472/12 is allowed and it is directed that order dated 25.7.2012 in criminal revision no.137/12 of ASJ Rehli by which he remanded the case for re-hearing and decide it within a period of one month is hereby stayed.

Issue notice to respondent of this petition by both the modes i.e.RAD and ordinary on payment of PF within seven clear working days returnable within four weeks.

List after four weeks.
