This petition is filed seeking review of the order dated 4.9.2012 passed in W.P.No.14351/2008 by which the writ petition filed by the petitioner was allowed.
Learned counsel for the petitioner submits that during the couRs.of hearing in the writ petition he had made a statement that petitioner had supplied 5,75,000 Bhu-Adhikar and Rin-Pustikas to the government press, while the factual position is that 6,03,000 Bhu-Adhikar and Rin-Pustikas were supplied by the petitioner, which were accepted by the respondents.
So far as the supply of 5,75,000 Bhu-Adhikar and Rin- Pustikas is concerned, learned counsel for the petitioner submits that petitioner has received the payment during the pendency of the writ petition, but so far as the payment of remaining 28,000 Bhu-Adhikar and Rin-Pustikas is concerned, the petitioner has not been paid.
It is submitted that to this extent the order dated 4.9.2012 may be modified.
Shri Jaideep Singh, learned Dy.
Government Advocate, appearing for the State, submits that in case the aforesaid 28,000 Bhu-Adhikar and Rin-Pustikas have been supplied by the petitioner and accepted by the government press, the respondents shall examine the matter and in case the aforesaid fact is verified, the respondents shall release the payment of aforesaid 28,000 Bhu-Adhikar and Rin-Pustikas in terms of the earlier order dated 4.9.2012.
As the learned counsel for the respondents has come forward, considering the case of the petitioner we deem it appropriate to dispose of this petition with the following directions:- 1.
The respondent No.2 shall examine the fact that whether the petitioner had supplied 6,03,000 Bhu-Adhikar and Rin- Pustikas to the respondent No.2 which were duly accepted by the respondents.”
2. In case the aforesaid Bhu-Dahikar and Rin- Pustikas have been received by the respondent No.2, the respondent No.2 shall release the payment of remaining 28,000 Bhu-Adhikar and Rin-Pustikas, if no payment has already been made to the petitioner.
With the aforesaid direction, this review petition is finally disposed of with no order as to cost.
