JUSTICE PRASHANT KUMAR For the Petitioners: Mr. Kailash Prasad Deo For the State: Mr. Niki Sinha, APP 5/06.09.2013: Anticipatory bail application filed by petitioners Daroga Murmu, Alam Soren and Sukhdeo Mirdha is moved by Sri kailash Prasad Deo and opposed by Mrs. Niki Sinha, learned Additional P.P. This is a case under sections 406 of the Indian Penal Code. It is alleged that petitioners had misappropriated a sum of Rs. 69,200/- from the State Exchequer. Learned counsel for the petitioners submits that his clients are ready to deposit a sum of Rs. 69,200/- , as a condition for bail, without prejudice to his case. In view of the aforesaid undertaking given by learned counsel for the petitioners, I allow this application and direct the petitioners to surrender in the court below by 18.09.2013 and file a Treasury Chalan showing that they have deposited Rs. 69,200/- in the State Exchequer as a condition for bail and in that event the court below is directed to enlarge the petitioners, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand)each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Godda in connection with Mahagama P.S. Case No. 73 of 2005 ( G.R. No. 763 of 2005) , subject to the condition as laid down under section 438(2) of the Cr.P.C. It is made clear that the aforesaid deposit made by the petitioners will not prejudice them in their defence. ( Prashant Kumar,J.) Sharda/-
