( s) no. 450 of 2013 ram anugrah jha ...petitioner -versus- the state of jharkhand & others ..respondents --- coram : honble mr. justice aparesh kumar singh --- for the petitioner : mr. arbind kumar, adv. for the respondents : mr. ratnakar bhengra, adv. ---- 04/ 20.8.2013 heard learned counsel for the parties. according to the petitioner, he has retied on 31st may, 2011 while working as conductor-cum-clerk from the office of respondent at dumka. he submits that the respondents authorities be directed to release the gratuity, leave encashment as also fix the final pension and other retiral benefits of the petitioner with statutory interest learned counsel for the respondents-state submits that if the petitioner approaches the competent authority he may look into his grievances in accordance with law. in such circumstances, in the matter of claim of post retirement dues, at this stage without commenting anything on merits upon the claim of the petitioner, the writ petition is disposed of by allowing the petitioner to approach the respondent no.4, divisional manager, department of transport, dumka with fresh representation for redressal of his aforesaid grievance within a period of 3 weeks together with all supporting facts and documents. on receipt of such representations the respondent no.4, divisional manager, department of transport, dumka shall consider the same in accordance with law and after proper verification of the records of the petitioner, pass a reasoned and speaking order within a period of 12 weeks thereafter, which shall also be communicated to the petitioner. if any of the claims of the petitioner are found to be genuine and legally admissible, the same shall also be paid within a further period of 8 weeks thereafter. accordingly, the writ petition is disposed of in the aforesaid term.
