Anticipatory bail application filed by Lalta Prasad Yadav is moved by Sri B.K. Dubey, learned counsel for the petitioner and opposed by Sri V.K. Tiwary, Addl.P.P. for the State. It is submitted by learned counsel for the petitioner that petitioner has done measurement only with respect to land belonging to Fulwa Devi, for which Rs.69,300/- has been paid from the State exchequer. Learned counsel further submits that petitioner is ready to deposit aforesaid amount in the State exchequer, as a condition for bail without any prejudiced. Considering the aforesaid fact and circumstance, I allow this application and direct the petitioner, named above, to surrender in the court below by 07.09.2013. Petitioner is further directed to file treasury challan in the court below showing that he has deposited Rs.69,300/- in the State exchequer. If the aforesaid treasury challan is filed in the court below, the court below is directed to enlarge the petitioner, named above, on bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Civil Judge Junior Division-VI, Koderma in connection with Satgawan P.S. case no.79 of 2012, corresponding to G.R.No.1220 of 2012, subject to the condition as laid down under Section 438(2) of the Cr. P.C. It is made clear that aforesaid deposit made by the petitioner will not prejudice in his defence. ( Prashant Kumar, J.) Pramanik/
